If marines, Italy called the US to repatriate round – BBC

Milan , December 22, 2015 – 07:27

There is expectation, in these days of pre-Christmas, for some news in the case of marines. Roman political circles indicate that Matteo Renzi would take an initiative to try to help turn the story, if not definitive at least partial pending prosecution of the arbitration panel recently made that will determine where to hold the trial of Salvatore Girone and Massimiliano Latorre. The President of the Council would have involved in the situation – it is unknown to what extent – US President Obama, who would be concerned about how the case is having negative effects on the input full of India in the ranks of world powers reliable.

In the more optimistic outlook , the government of Narendra Modi would give an indication of the state attorney and the Ministries of Interior, Justice and Foreign Affairs to ask the Indian Supreme Court to freeze the case pending the outcome of the arbitration and to free round today on bail in Delhi, and Latorre, convalescing in Italy. This would be a move soothing India which also put the arbitration panel in a position of greater peace of mind to decide where you have to carry out the process for killing two fishermen Kerala State on 15 February 2012. The Marines expect the decision in Italy.

A second hypothesis is that the government Delhi gives some indication as to the judge Indian who is part of the arbitration panel, Chandrasekhara Rao, keep a positive attitude when the college itself will discuss the Italian request for provisional measures to be applied to the case. Rome has in fact made a request that the five judges establish, among other things, that Latorre and Girone can expect the choice of jurisdiction at home. Towards mid-January, it is expected to arrive the Indian response. Then, in February, there will be hearings around the college and in March there should be a decision. If Delhi were to be collaborative, provisional measures would have more chance of being accepted: referees are Rao, Korean Jin-Hyun Paik, the Russian Vladimir Golitsyn – all three members of the International Tribunal for the Law of the Sea in Hamburg – the Jamaican Patrick Lipton Robinson of the International Court of Justice in The Hague, the Italian professor Francesco Francioni, a professor of international law at Siena.
In either case, even if the initiative goes ahead the two Italian marines should then respect the decisions of the referees and accept being judged where they will decide, in India, in Italy or in a third country.

Barack Obama and the US Administration would be taken by surprise by the Italian decision this fall to block the entry of India MTCR, the technology group that It is dealing with missiles, which are part of the 43 countries and is considered an important club of the countries that are working to strengthen the non-proliferation of nuclear weapons potential and place controls on exports of missile systems.

In his diplomacy tense to strengthen strategic relations with India, Washington had promised to Modi, on January 25th, that the United States would favor the entry of Delhi MTCR and in three other similar bodies that deal with nuclear supplies (NSG) and weapons of mass destruction (Wassenaar Arrangement and Australia Group). Since MTCR need to enter the unanimity of the members, the Italian opposition has blocked the admission of India. This would have worried the White House
The next meeting at which the entry of Delhi will again be discussed will be held in the spring. From here, the window of opportunity to engage Washington and groped a further step in the long story of the marines.
