If Vivi Down: the Supreme Court agrees with Google - Tom's Hardware Guide

The Third Criminal Chamber of the Supreme Court confirmed the acquittal for executives Google , who in 2006 became involved in the case Vivi Down. Thus ends one of the most disturbing events which have affected the school and YouTube.

In 2006, a young disabled Turin was resumed and harassed by classmates . Video-shock jumped to the headlines because of the cruelty of the images and the audience generated on Google Video (first) and YouTube (after).

Court of Milan

On 24 February 2010 the Court of Milan convicted three managers of Google, which at the time had direct responsibility in the service, to a penalty of six months imprisonment with the same suspension. Judge Oscar Magi recognized a serious violation of the Privacy Act but acquitted the leadership of the crime of libel.

Into December 2012 came the acquittal on appeal because any infringement committed by users can not be the responsibility of the service provider. Now the Supreme Court dismissed the appeal last judgment requested by prosecutors in Milan.

Deputy Attorney General Mario Fraticelli argued that “you can not think that anyone who provides a service on a platform then do not mind what is loaded.” The Supreme Court, however, take the opposite view and in about a month will state the reasons for the verdict . In any case, any new appeal process would be blocked by prescription – scheduled for 8 March 2014.
