The new rules on copyright - The Press

Into The Authority has presented a new text with measures to combat online piracy. A similar attempt had failed in 2012. Now 60 days to reactions and comments

Into The NRA will try again on digital copyright. The authority has launched a new regulation on online copyright aims to contrast sharply the phenomenon of digital piracy, especially for what concerns music and movies. An attempt which had tried to carry out even the previous board of AGCOM, a year ago, causing an avalanche of complaints to those that were interpreted as “censorship” freedom of the Net

Into this time the Authority chaired by Angelo Marcello Shaft provides a process which will take effect only at the request of the party entitled (and therefore not office) and will last only 10 days, after which – if the violation will be established – will start the ‘order of removal of content targeted at Internet Service Providers.

Into The stated goal is to AGCOM to target violations for profit and piracy “massive” online, but to exclude from the scope of intervention end users ( ??downloaders ) and the so-called “ ??peer-to-peer .” The text will be submitted for consultation for 60 days and also provides an opinion of the European Commission. If the times are respected, the regulation could come into force in early 2014.

Into The Authority, in a note, he “intended to balance the protection of copyright with certain fundamental rights, such as freedom of e xpression and information, the right of access to the Internet, the right to privacy” .

Into ‘The procedure for enforcement proposal, even though they are in a short time, respects the principle of audi alteram partem – underscores the NRA – in order to allow all interested parties to argue their case. ” It is expected that the proceedings before the Authority “may only be initiated at the request of the person entitled, no office, and having turned, without success, a removal request to the manager on the Website.”

Into The measures taken in consultation “are those provided for by Legislative Decree no. 70/2003 – selectively removing or disabling access to illegal content – and they will be marked by appropriateness and proportionality, taking into account the severity of the violation and the location of the server. ”

Into The intervention AGCOM ‘is founded on the belief that anyway to comb at illegality can not be confined to the work of contrast, but must be accompanied by a series of positive actions of crucial importance: the promotion of legal , information and consumer education, essential to create a “culture of legality” through the contents. ” In this perspective, the Authority considers that “piracy can be reduced thanks to measures encouraging legal access to digital works.”
